Revisions to sentencing under the Health and Safety (Offences) Act 2008, to be introduced on 16th January 2009, could see company directors and managers subject to a maximum two year prison term, and or a £20,000 fine, if found guilty by a Crown Court of failing to properly discharge their duty of care to others
David Carless, Chairman of Shropshire Advanced Motorists, (affiliated to the Institute of Advanced Motorists), warns the Act could be used to prosecute business owners whose managerial failings are deemed to have led to a car accident as a result of an employee's poor driving standards.
“Many Chamber members we spoke to over the past year revealed they are scrutinising repair costs, employee and vehicle downtime arising from bumps and more serious collisions,” said David, adding: “These businesses are looking at efficiency savings as a matter of good cost control practice.
“The new Act brings into sharper focus the need for companies to offer personnel who drive as part of their routine business every opportunity to ensure their driving is up to standard. Directors are responsible for ensuring that their drivers are competent, otherwise they may be vulnerable under the new legislation.”
